Terms information

This document determines the terms of business, i.e. the purchase of products via the PRIMABELLA International website (hereinafter referred to as "Terms and Conditions"). These Terms and Conditions prescribe the conditions and rules related to the use of the Internet pages by the Customers.

 The terms of distance sales are subject to the Law on Consumer Protection, the Law on Electronic Commerce, the Law on Trade, the Law on Obligations, as well as other valid regulations of the Republic of Serbia. By accepting these Terms and Conditions, you also accept the method of returning, i.e. replacing and returning PRIMABELLA International products.

PRIMABELLA Internationa reserves the right to amend and/or amend these Terms and Conditions at any time. The Customer is obliged to check the Terms and Conditions in the relevant chapters/sections before each Order, as changes may occur between visits or are the result of updates.

After registering on the website, Customers/Registered Users declare that they have read and understood these Terms and Conditions, that they are familiar with them and fully agree, and that they agree to use the website in accordance with them. The right to use the website is not transferable to other natural or legal persons. The registered user is personally responsible for protecting the confidentiality of codes (passwords), where they exist.

 Definitions and terms

 Visitor - a person who uses the www.primabellashop.com website, regardless of whether he purchased products or services through them.

Registered user - registered Visitor of the website, regardless of whether he makes a purchase or not.

 Customer - buyer of products who buys at least one product through the PRIMABELLA International online store. A customer is also a person who orders products or services by phone through the Contact Center.

 Seller - PRIMABELLA International d.o.o. Belgrade

Order - the PRIMABELLA International form completed by the Customer including the online/electronic form following the necessary steps to purchase the product(s), and/or services sold in the PRIMABELLA International online store, as specified in the Terms and Conditions. The Order also includes filling out the online/electronic form that the Buyer fills out and sends to the Seller for the purpose of purchasing products and services.

 Contract - a bilateral contractual relationship between the Buyer and the Seller, in accordance with these Terms and Conditions, which the Buyer expressly accepts by purchasing goods remotely. The terms and conditions are considered an integral part of the Agreement.

 Information about the PRIMABELLA International online store

 On the website, we strive to ensure the accuracy of information, including descriptions of our products, as well as up-to-date when changing the prices of products. Unfortunately, sometimes there may be errors. We will try to remove the difficulties as soon as possible.

 If the resulting difficulties would affect the status of the Order, we will definitely inform the Customer about it without delay.

 Intellectual property right

In accordance with our rules on privacy and intellectual property, all content and material published on the pages: www.primabellashop.com is fully and exclusively the property of the PRIMABELLA International d o o. The use of the content of this website/domain without the express consent of PRIMABELLA International is not in accordance with the regulations governing the protection of intellectual property.

 Each Visitor of the website expressly agrees to use these websites solely at his own risk. Neither PRIMABELLA International nor any of its employees, agents, third party service providers or licensors warrant that use of these websites will be uninterrupted, intercepted or error free; nor does it guarantee (i) the consequences that may arise from the use of these websites, or (i) the accuracy, reliability or content of any information, services or products provided through these websites.

 This statement of liability applies to all direct (actual damage), or indirect damage (lost profit), possible injuries caused by any defects, errors, omissions, interruptions, deletions, malfunctions, delays in operation or transmission, computer viruses, interruptions in communication connection, theft, destruction or unauthorized access, changes or misuse of records on the computer equipment or property of the Visitor, termination of the contract, inappropriate behavior, negligence, or any other action of the PRIMABELLA International company, i.e. its employees, agents and/or third party service providers. The Visitor expressly confirms that the PRIMABELLA International company is not responsible for any possible offensive, inappropriate or illegal behavior of other users or third parties and that the risk of damage that may arise as a result of the aforementioned is fully borne by the Visitor.

 In no case shall PRIMABELLA International, or other natural or legal persons involved in the creation, production or distribution of these websites, or related content and/or software, be liable for any damage that may arise as a result of the use or inability to use these Web page. The visitor expressly confirms that the Terms of this chapter apply to the entire content of these Internet pages.

 The Visitor is solely responsible for the acquisition, use and maintenance of his computer equipment, including but not limited to all software and hardware that he owns and uses, as well as other equipment needed to access and use the PRIMABELLA International online sales website and all related costs. PRIMABELLA International is not responsible for any damage to the Visitor's equipment that may occur as a result of using these websites.

 For the purpose of avoiding any doubt about the disclaimer of responsibility by the company PRIMABELLA International, the Visitor will not be denied the prescribed rights, as well as the rights arising from the contractual relationship with the company PRIMABELLA International.

 PRIMABELLA International is committed to protecting and respecting your privacy.

 PRIMABELLA International makes every effort to protect all personal data used when purchasing products (eg protection of personal data when sending promotional materials, when placing an Order, as well as when paying by card).

 Product information

 Buying products via the online store you need to pay attention to the following details:

 The color of the product in the photo on the website may differ from the color in reality. If the product is offered in other colors than the one shown, information about other available colors can be found with the product itself. Photos, renderings and images are for informational purposes only.

 In the content of the price tag, that is, on the declaration, there is also basic information about the product, while for more detailed information, the customer can always contact PRIMABELLA International, and details about the product can also be found on the PRIMABELLA International website, in the product information section.

 Products will be delivered in the ordered quantity if they are available, but there is a possibility that PRIMABELLA International cannot deliver the Order in part or in whole.

 The PRIMABELLA International company will try to ensure that the information on the website is up-to-date as much as possible, especially the prices of the offered products and services.

 The PRIMABELLA International company is not responsible for possible errors in the product description, images, and errors that occur during page updates and price changes.

 If it is an error that significantly affects the Buyer's decision on the Order, the Buyer reserves the right to cancel or modify the Order.

 Availability of products

 Information about the stock of products in the PRIMABELLA International department store changes and may differ from the information published on the website or in the application.

 PRIMABELLA International reserves the right to withdraw any product from sale at any time. In such cases, the company PRIMABELLA International returns the full amount of money to the Buyer of the undelivered but paid product.

 Conformity of goods to the Agreement, Conformity guarantees and complaints handling

 PRIMABELLA International is responsible for the non-conformity of the goods with the contract that appears within two weeks from the date of transfer of risk to the consumer (legal guarantee), unless otherwise stipulated by the applicable regulations of the Republic of Serbia.

 Your consumer rights regarding the conformity of the goods are protected by reporting a complaint to the seller. In order to exercise these rights, it is necessary to attach the invoice for inspection or other proof of purchase with the complaint (copy of the invoice, fiscal slip, slip — if the goods were paid for by card, printed statement from the current account, etc.). The period of validity and duration of the warranty and everything covered by the warranty in relation to a product is specified with each product. The seller is responsible for the non-conformity of the goods within 2 weeks from the transfer of risk to the consumer.

 In order for the guarantee to be valid, it is necessary to follow the specific instructions for use, maintenance.

 The consumer can file a complaint with the seller in order to exercise his consumer rights regarding the conformity of the goods with the contract and the warranty statement, as well as due to incorrectly calculated prices and other defects. PRIMABELLA International has a prominent notice at the point of sale about the method and place of receiving complaints, and at all times a person authorized to receive complaints during working hours.

Complaints can only be accepted with delivery of the invoice for inspection or other proof of purchase (copy of the invoice, slip, etc.). Please note that it is necessary for PRIMABELLA International to physically inspect the goods to which the complaint refers, and it is certainly preferable that you submit a photo of the product to which the complaint relates in order to be able to process the complaint as quickly as possible.

 Upon receipt of the complaint,PRIMABELLA International will investigate in a reliable manner without delay whether the complaint is justified and respond to the stated complaint in writing or electronically within 8 (eight) days at the latest from the date of receipt of the complaint.

 Liability for material defects will be resolved in accordance with the provisions of the Law on Consumer Protection, the Law on Obligations and other valid regulations of the Republic of Serbia.

 Any disputes between the Customer and PRIMABELLA International will be resolved amicably, otherwise the jurisdiction of the court in Belgrade is agreed.

 Registration

 You must be at least 18 years old for internet purchases.

 The buyer is responsible for the accuracy and completeness of the data entered during the purchase.

 Order - general

 PRIMABELLA International products and the delivery service can be ordered online in accordance with these Terms and Conditions.

 If the ordered products are not available in the warehouse, PRIMABELLA International Contact Center employees will call the Customer within 4 working days after sending the confirmation of receipt of the Order.

 PRIMABELLA International will endeavor to deliver all products ordered by the Customer, but reserves the right to refuse the Order in cases of force majeure or when the performance of the contractual obligation is significantly more difficult. If the company PRIMABELLA International rejects the Order, the Customer will be informed about it within 4 working days after sending the confirmation of receipt of the Order.

 Online ordering

Products and delivery services are ordered electronically through the PRIMABELLA International online store. Products are considered ordered the moment the Customer completes the entire ordering process. Then the Customer will receive a confirmation of receipt of the Order by email.

 Upon creation and confirmation of receipt of the Order, the Customer will receive a confirmation that PRIMABELLA International has received the Order to the provided email address.

 Order cancellation

 General terms of order cancellation

 The customer has the right to cancel the Delivery Service Order at any time by contacting the PRIMABELLA International Contact Center by email from 09:00 to 20:00 (CET) every day of the week.

 If the Delivery Service Order is canceled before the products have left the PRIMABELLA International warehouse, the Customer has the right to request a refund of the total amount for the products and delivery.

 If the Order is canceled after the products have left the PRIMABELLA International warehouse, the Customer has the right to request a refund for the products, but in this case the Customer bears the costs of returning the products to the PRIMABELLA International warehouse. For more information about these conditions, see the previous sections of the Terms and Conditions.

 Order cancellation procedure when ordering via the Internet

 Upon successfully placing an Order via the Internet, the Customer receives the so-called a confirmation email (i.e. confirmation of a successful Order sent by email).After the goods will be sent to the Customer, another emai lwill be sent which will contain a link through which the Customer can track the status of the Order.

 On the page with the status of the online Order, in the lower right corner, there is an option to cancel the Order by clicking on the button.

 The PRIMABELLA International Contact Center processes the order cancellation request during online ordering and informs the Customer of the outcome electronically to the Customer's provided email address.

 The customer is informed that it is possible to cancel the Order when ordering online.

 Procedure for canceling a telephone order

 Product collection rules

 The products are collected according to the Order, so the goods will be delivered to the Customer's delivery address specified when the Order was placed. By confirming the Order, the Customer shall be deemed to agree to the following:

 I accept responsibility for the accuracy of the data and delivery address.

 I will try to return the products in their original packaging, unopened and unused. In case of deviation from the original packaging of the product, I accept the PRIMABELLA International exchange and return policy for opened products.

 The product return form must be signed by the Customer, who is returning the products.

 The price

 All prices displayed in the PRIMABELLA International online store are expressed in EURO and include VAT.

Products are charged at the prices valid on the day of ordering and published on the website. Prices, payment terms and promotional offers are valid only at the time of payment and may change without prior notice. PRIMABELLA International will endeavor to ensure that the prices listed in the order are accurate, however errors or discrepancies may occur.

 In the event that the price of the product changes during the processing of the Order, or the price on the website for any other reason does not correspond to the actual price of the product or service, the PRIMABELLA International company will enable the Customer to cancel the purchase or to confirm the new changed price.

 Shipping costs will be indicated separately and added to the total price of the ordered products.

 Shipping costs will be calculated based on shipping method, package weight and shipping address.

 Payment

 Payment for goods and services ordered through the PRIMABELLA International online store is made electronically. For purchases in the PRIMABELLA International online store it is possible to use debit or credit cards in PayPal system.

 General

 Delivery service is possible only for PRIMABELLA International products.

 PRIMABELLA International provides the delivery service r through its subcontractors that it engages under the contract.PRIMABELLA International reserves the right to conclude a contract with different delivery services, provided that the quality of the delivery service remains identical and corresponds to PRIMABELLA International standards.

 Delivery is made to the address specified in the Order.

 Fee and delivery terms

 The fee for the delivery service is indicated on the Service Order and is calculated in accordance with the delivery method, package weight, dimensions, as well as the location and delivery address.

 After the order has been created, the Customer will receive an email confirmation that the order has been received, and the email will contain the order details, including the delivery time.

 Delivery restrictions

 Delivery can also be suspended due to force majeure, events, actions or circumstances that could not be foreseen, including the following but not limited to: natural and elemental disasters, closed roads due to weather or the arrival of foreign delegations, damage or road works, facility or installations, demonstrations or gatherings.

 The products will be packed so that they cannot be damaged by normal handling..

 Once the goods are delivered to the Buyer or the person who received the goods, the Buyer becomes the owner of those products and is responsible for any subsequent damage, loss or destruction of the products.

 OTHER SERVICES

It is important to us that customers are satisfied with the purchase of PRIMABELLA International products, it is okay for the customer to change his mind. You can return the purchased products within 14 days after receiving products, according to the conditions in the PRIMABELLA International warehouse return policy, which is an integral part of the purchase conditions.

 For products that you receive, try on and return undamaged, without signs of usage within the first 14 days from the day of receiving goods, we will refund the full amount (excluding delivery fees) according to the original payment method. We reserve the right to refuse a return or exchange of a product if the criteria are not met. If you return a used product after 14 days from the day of delivery, we will assess the condition of the item according to the conditions described in the PRIMABELLA International return policy, which you can read more about here.

 If the returned product does not meet the above criteria, PRIMABELLA International reserves the right not to refund the money. Also, in that case, PRIMABELLA International can offer the customer either an exchange with a reduction in price because the criteria for refunding the amount paid for the product are not fully met.

 Exchange and return of the product is done by sending it back with the original receipt or other proof of purchase to the PRIMABELLA International warehouse address: Beograd, Zara Urosha 12.

 The customer agrees to return unused products in their original condition and, if possible, in their original packaging. If the Customer returns the products because he has changed his mind, he bears the costs of returning the products to the PRIMABELLA International warehouse.PRIMABELLA International reserves the right to refund the reduced value of the product if the product has been used or damaged.

 If the conditions for returning the product are not met, PRIMABELLA International has the right to refuse a refund.

 PRIMABELLA International bears the costs of transporting returned products only if the product is defective or damaged or if a product was delivered that the Customer did not specify in the order.

 PRIMABELLA International reserves the right to refund the reduced value of the product if the product has been used or damaged.

 The right to withdraw from the contract

 In addition to the rights defined in these Terms and Conditions related to the return of products, according to current regulations, the Customer, in the case of online purchase, has the right to cancel and return the purchased goods, within 14 days, for any reason and without explanation. In case of cancellation, the Buyer is obliged to return the product in its original packaging, and if possible, unpacked.

 The customer organizes and bears the costs of returning the product to the warehouse
